PLEASE HELP-- my question,got pulled over by a CHP officer for following him too close during a FWY break-HELP

How can I fight this ticket in court--The officer I beleive was a rookey and cited me for no reason.

  1. the first thing to do is do a trial by declaration.  It is a written statement to the court.  Once you get the info in the mail it should tell you how.  The good thing about this is you plead innocence (any other plea will get you a fine, no contest is basically the same as guilty)  The good thing about trial by declaration is if the officer doesn't submit his own story you win.  And unlike court hearings the citing officer has no incentive to reply be a trial by declaration.  

    If you don't win then you still have the ability to show up in court and plead your case.  Kindof like an appeal.  You have another chance to plea your case.  There isn't much you can do here, i've been to the court system and you are pretty much seen as guilty until proven innocent.  I tried going about my case as if there was not enough evidence and there was reasonable doubt.  The judge told me she wanted proof that i was innocent.  So much for innocent until proven guilty.  Usually you have a slim chance of winning in court, but do trial by declaration.  It might work.


  2. Tailgating a CHP? You're outta luck. Best you could hope for is go to court, apologize and say you didn't know what the officer was doing.  Traffic breaks are kinda unique to California.  The only way an out-of-stater would know what they were is if he saw CHiPs reruns.

  3. You can fight this ticket in court, but I do not see you beating it.  It will be the officer's word and potential video evidence against your word.  The officer's word will win.
