PLEASE HELP (selling my car/title problems) ?

I purchased my 91 Nissan 300zx in Feb in CALIFORNIA.

The seller signed the title over, but I HAVE NOT SIGNED IT YET.

I did NOT register it with the DMV or send the title in to the bank

(I still owe on the loan) ... I defaulted on it.

fast forward to August.

I moved to Alabama and left the car in california when I got out of the Marines.

I found someone to purchase it, and my friend is going to take care of the transaction for me.

-Can the new buyer just sign where I was supposed to sign originally? or does my friend need to sign the title for me (signing my name of course, with my permission) and then I can just write up a bill of sale?

Now there is also a possibility that the title may have been lost.

I will know tomorrow night if they find it, but how can I sell the car if the title is lost?

  1. Right now what you have is a open title, this means that the owner of the car had it in his name and he signed the back of the title,(Releasing it to you).Ok if it's like i just said it is, then you do not need to sign it ,just have the person that's going to buy it from you to sign the back of the title.This way you never had any thing to do with the car..If you lost the title then that's a problem,because by law the car is still in the other person name and he would need to file for a  lost title,he can do this with the lisense plate nuimber. Here in Texas that fee is 3.oo bucks


  2. go with your friend to dmv with vin# and ask them but don't mention the lean on title  

  3. If the title is lost the person that owned the car has to get a new title and sign it as seller and your friend can sign as buyer and you won't have to sign.

  4. You CAN do it but you should not do it.  It is called "jumping the title" and is illegal.  Legally, you cannot sell that car until it is your car.  Right now it is still legally the other guys car.  What you are proposing is done every day but if you are caught, there will be consequences
