So back in April i was hit by a drunk driver, i am okay, no major injuries, there was 4 people in the other car, both cars were totalled, the driver ran the red light and the police report said it was his fault, our insurance companies are both still fighting over who's fault it was,

I am currently trying to sue the other insurance company, i am deathly scared of driving now and i am even scared to be in a car, i have nightmares that these 4 guys know where i live and i am afraid they are going to kill me, I c

I would also like to file a suit against the police deparment, when the accident happened 3 out the 4 people were visably drunk, and the police took notice to that, i offered to take a sobritety test along with the other 4, and they didn't listen, they did however get blood work done at the hospital which proved the driver was under the influence,

3 out of the 4 of them went to the hospital, even though i KNOW they wern't injured, now one of them is suing my insuance..

  1. If you sue their insurance company, you are going to lose.  Their insurance company didn&#039;t hit you.  They did.  You have to sue the owner of the car, and the driver of the car.

    The police do NOT determine fault.  Fault is determined by state standards.  Just because they got a ticket, does NOT automatically make them at fault.

    Sure you can sue the police.  For what?  They didn&#039;t cause you any damages.  You&#039;re going to lose that suit.  You&#039;ll have to pay a lawyer up front to take that case - money down the drain.

    Yes, they can sue you.  Here in the USA, anyone can sue anyone else.

    Just a reminder to you - their insurance company, assuming they had insurance, and the driver was covered - isn&#039;t going to pay out more than the policy limit for damages.   Also, depending on what state you are in, you COULD be held at least partially at fault for this accident.

    and, in some states, you can&#039;t collect &quot;pain and suffering&quot; for minor injuries.  Your fear issues are your fear issues - you&#039;re not going to get &quot;paid&quot; for them.  Especially if you don&#039;t turn in your license.

    Your plan to &quot;sue the police dept.&quot; sounds nutty.  And you are not qualified to determine who was or was not hurt.

  3. You definitely need to consult an attorney. They will give you a free consult. Insurance companies will jerk you around if you don&#039;t have an attorney, so please go get one now!

    I don&#039;t think they can sue you since they were at fault and drinking.

    Yes you can file a suit against the police but, again, you definitely need an attorney. He can advise you if you have a suit.

    Good luck. I have been there and I KNOW how the insurance companies will treat you. They will be nice at first....... you also need to MAKE SURE you are not hurt. Sometimes even your back or neck can hurt later.
