Paid Rs.100000 advance for flat on 10/- stamp paper by cheque,builder want to sell by other.Legal Advice pl.

Question

Against my written stamp paper and cheque paid advance builder has not given any notice for cancellation of deal.Only he has informed several times to get back the advance paid.As the rate for Navi Mumbai area is raising day by day. Any customer has given high rate to builder,that's why he has got advance from him.As per the statement of Stamp paper builder will wait till sanction of loan amount from bank but he is refusing.At present I have arranged the total amount to pay him by cash/Cheque.Pl.suggest me the way that how I can get the same flat on same rate.

if u paid 100000 in advance than builder gven u on stam paper & not in any legal propert'y documents is there no stationery of building related documents........
