Paid off mortgage owed against business. What now?

My mother went to get papers done swapping her name for previous owners name. She recently paid off a business that she has made installments on to an independent business owner. clerk of courts told her this would have to done by a lawyer with proof of pay off of mortgage. anyone know what the lawyer would be doing that we couldn't do? state of Louisiana

  1. No lawyer needed.  THere are 2 parts to "paying off" a mortgage.  THe first is that you made the last payment and received a Paid In Full from the lender.  This could be a white piece of paper with the lender's signature. Most lenders write it on the original "note" and keep a copy for themselves.  It's paid off, they don't need it any more.

    Part 2 is that your mom needs to get the proof "recorded" at the county Recorder's Office.  Also very easy.  This has to be notarized, tho.  The Recorder insists on that.  You write on a piece of paper  Satisfaction of Mortgage at the top and write that the loan which had previously been recorded has been paid off and is no longer owing.  Mention the exact details of who was the lender , the borrower, the date the original loan was recorded (the Recorder can tell you that, it might be online... also it's stamped on the lender's copy if he can find it).  The lender signs in front of a notary.  You take it to the Recorder and pay $10.  All done.  Most attorneys have never done one in their lives.
