Parked good cont'd car totaled by drunk driver can't get other car with insur. co. offer. what should I do?

  1. If you have comp/collision then file through your own company but you will have to pay your deductable. If you car is worth less than what is owed(if financed) then you will owe money out of pocket. Unless you have gap insurance. They will only pay book value.


  2. Check your cars actual value on Kellys Blue Book and see if that is what the insurance company has offered you.

    If its not, phone them and tell them that you feel your car is worth more, and that KBB values the car at more than what you offered.

    Otherwise, unless you can prove that your car was in above average condition, you will have to take their offer.

    Im not from USA, and I dont know how it works over there, but you may be able to take the drunk driver to court and sue him for the actual value of your car if the insurance company wont cough up the rest.

    Either that or buy a cheaper car...
