Question:

Parking fine on private property. Can I be fined for parking on private property which is a part of my flat.?

I have received a parking fine on private property. The car park is part of the flat complex in which I live. I am legally part shareholder of the car park. They state that an invalid permit was used and under the terms of the display I must ensure that a valid parking permit is displayed before leaving the car. The definition of a valid permit was recently changed and displayed within a communal area not in the car park or sign.

The appeal has been rejected.

The changes were not posted to my address. I have two questions:

a) Can acceptance occur if you cannot read specific defintions without leaving the car and ample notice has not been communicated to you?

b) Under tort, can I be charged for entering my land by someone who is not the land owner as I have not trespassed, thus essentially barring me from entering my property without charge?

  1. If UK  I think you will win ,get the local TV involved better if other dwellers are also angry or on your side  I understand if tenant request gates or parking meters or the likes wheel clampers and installed you have a lesser case all the same you should have been kept informed

If you have some sort of an association and rules you are required to comply with the rules, if there are no rules for the association, then I don't see how you can be ticketed for entering your own property, since you are the claimant and you can't sue yourself.  If the warning is not readable, it is probably not enforceable either.  There are usuallly rules that specify the readability of signs.
