Parking lot accident?

Ok I was completely backing out of a parking space stop to put in first gear when the the other car back into me, who would be at fault

doesn't matter if it's private property in a tort case.

if someone is liable for damage to your car, on private property or not, they have to pay.

in this case, it seems like it's 50/50

In Louisiana, neither would be at fault. In a parking lot, it is considered private property. Neither gets a ticket.
