Parking ticket in Kent: can I appeal after i have paid the fine?

I already challenged the ticket through the council who rejected it. I paid the fine but would still like to appeal. Can I do this?

The details of the offence are: leaving my car unattended on a single yellow line for 6 minutes while loading. This means the authorities say my loading was interrupted. My 3 year old decided she need to go to the loo (for a poo!!) which she was unable to do unattended and meant I was a minute over the (unpublicised) 5 minute guideline which apparently councils operate under.

I would have to neglect a child to comply with law. Who are the retards making such decisions?

Article 37

States Parties shall ensure that:

"(a) No child shall be subjected to torture or other cruel, inhuman or degrading treatment or punishment. .."

Cruel & inhuman ..I think so!!!!

  1. Your case and reason for leaving your vehicle unattended is valid as far as I'm concerned and I wouldn't give you a ticket under these circumstances.  However, I don't make the rules and its up to the discretion of the relevant officer / warden if they give you a ticket or not.

    As for appealing, if you've paid the fine then you are technically admitting that you committed the offence so I doubt it will get you anywhere.

    It may be worth a try though to see what happens.

  2. I once paid and bought a ticket at the wrong meter two car parks very close togther . I wrote letter to the council and explaining in very clear and assertive way don't get cocky they  don't like it but as long as you explain that you had young child and the circumstances they should ( should ) understand and send your money back I never paid but am told not many people contest and those that do mostly get there money back .   3. You paid the fine, that is accepting that you committed the offence.  They won't be interested in an attempted appeal now.

  5. Yes. They usually just reject the first appeal without even reading it, but will take notice the second time. People in the parking department are usually idiots, so if you know what you're talking about but don't offend them while writing back, then it might be successful.

    I've been studying law for a year and we still haven't covered the UN convention so I can't comment about how you would enforce that, but you would probably have more luck quoting the European Convention on Human Rights as if our country go against that, the people have the right to go to Europe to appeal. It would take a while, as you have to go all the way through our court system first, up to the House of Lords.

    I would ask a medical person for a more appropriate term to use for which toilet function she wanted to do, in an official letter, if you think that point is important.

    Edit:

    Ian, they put on my parking ticket that if I pay it and appeal they give you a refund, although I'm not sure if they should legally say that, as I did hear from another person that if you appeal then they keep a hold on the date that you can get a discount if you pay within a certain time, but they don't put that in writing to the people to make them scared and pay up as soon as possible.
