Party crashing cops?

Hi, i was wondering if i have kids drinking in my house with me (underage). and all the doors are locked and the cops show up and everyone goes quiet are the cops allowed to enter my home?

  1. Under that scenario, no. They can not.

    However, you are not the first one to think of that. Many a party planner thinks he will be able to control all his guests, but they rarely do.


  2. Since I worked in a smaller town, we'd just go through the neighborhood writing plates down. If we knew the kids that owned the cars sometimes we'd call mommy and daddy. They would come to the scene and usually see the kids inside giving us the finger. Then mommy and daddy could see what swell kiddies they had.

    There's lots a ways of handling this stuff. Usually works better when mommy and daddy get woke up to come see their kid acting out.

  3. Why did the police show up? Were you being loud enough to disturb the neighbors?  

    Where are your parents while this underage party is going on?

    To answer your questions, the police would only show up if they are called due to a complaint. If you do not answer the door, they may just wait down the street until one of your guests leaves, stop him/her, and find that underage drinking is going on.  After that, they will return to your parents' house and investigate further.

All they need is probable cause that a crime is being committed and they can come in without a warrant, no matter how quiet you are.  That could be a call from one of the kids' parents, a concerned neighbor, or one of the kids' friends.  Why in the h.e.l.l. would you want a bunch of underage kids in your house drinking in the first place?  If you are allowing them to do this without (or even with) their parents knowledge you deserve to be busted, and I hope you are you pervert.  

  5. Try this.

    Keep it to just a few friends you like and you know don't act like morons when they drink.  This will keep the police from getting any calls to go there. No police, no problem.

    If you're going to serve/furnish/allow alcohol for under age folks, do it somewhat responsibly and keep the cops away.

    If you plan on having a summer ending blow-out, expect the police and enforcement action.  Even if they don't enter, there is plenty they can do to make your/their life a living h**l for a little while.

  7. I can say that based on the information you provided it would not be permitable for the officers to force entry into a residence for a misdemeanor that may or may not be ocurring. Forced entry into a house is limited to warrants, exigent emergency circumstances such as a violent act in progress, check welfare where someone is possibly dying or in danger of dying (illness) etc etc. Underage kids possibly drinking would not be permitted  

  8. They have to have a warrant (unlikely) or the permission of someone living in the house.

    But just because you can get away with it doesn't mean it's a good idea.

  9. If they have reports of underage drinking, then they can bust in.  Good luck keeping a bunch of drunk kids quiet.

That scenario will not happen with a bunch of underage drinkers.  Someone will do something stupid and you will get caught.  In fact, you should get caught because you are breaking the law.  What if one of your buddies gets into a car and kills someone?  Guess what, he came from your underage drinking party and you could be held responsible as well, in civil court.  Drinking is really overrated and best left to those of legal age.
