Question:

Passenger rights?

Hi. I am wondering what (if any) rights international airline passengers have in Australia? The info I can find suggests that there are different 'rights' for passengers in the EU or USA when flights are delayed or overbooked for example. Are there any universal rights or does it depend on the carrier or on the country of booking?

Thanks for any help.

  1. Most "passenger rights" rules or laws are determined by legislation or the governing bodies such as the FAA or CAB  in the United States. The laws in one country don't apply in other countries, just like the laws in any country. However in the EU for example, any airline such as an American carrier is bound by the rules set by the EU for flights that depart from the EU. I would think that if you had a problem in Australia, you would have to refer to Australian rules or law regarding your particular circumstance no matter what country the airline was registered in. I may be wrong, but I don't believe there are any international passenger rights laws.

  2. You have the right to remain silent.

  3. when they are overbookeed they will standby you and if there is a delay ( this country had a problem with it) they will give you food, bathroom access and other things that you need after this problem happened with a jetblue flight

  4. No, there are no universal rights for delays or overbooking. In some countries (or groups of countries in the case of the European Union) of the world, passengers may have certain rights because of local legislation. Other "rights" are strictly up to the individual airline.

Check with your airline. They probably have a document that outlines their policies in these situations. This should include any requirements that are imposed by law. Some airlines even post this on their website.
