Passport for baby with out husbands permission

Hi. I have a friend who is married (to a complete idiot) and most of her family lives in Romania. She has a very sick grandfather that she would like to go visit with her baby, but her husband won't let her get a passport so she can take the baby to go visit. He is afraid she won't come back. This is not the case, she would never stay there. She is however planning on getting a divorce, because her husband told her he wants one. My question is can she get a passport for her baby without her husband's permission? Just incase you need this info, she lives in Minnesota.

  1. No, she cannot.

    Unless she has court ordered sole physical AND legal custody she cannot take the child out of the country - or even get a passport - without the other parents permission.

  3. The passport application does not ask if you have your hubbie's permission to get a passport.  It does not require his signature or his knowledge.   In the u.s., a husband has no greater authority than a wife.  

  4. Bottom line is HE IS AFRAID SHE WON'T COME BACK.  

    If they do divorce, it will be the same, if not more so. There are thousands of kids who are taken out of the country, for the specific reason of trying to avoid custody rulings in the US.  So, she will not be allowed to get a passport for the child, even after a divorce, since dad already has said no. The court will back him up, and passport applications can even be flagged for this reason.
