My friend, working for an aerial mapping company got his plane damaged by an operator towing his plane into the hangar.

The wing was dented and the damage came out to a total of $3000,now his boss is withholding that money from his per diem living expense check, although he did not cause the damage. What could he do to get out of this? Thanks

  1. Quit his job.

Because if he cracks up that plane, he'll never see another dime.

He can hire a lawyer, and see if he's got a suit to sue his employer - but he'll lose his job in the process.

  2. The company managing or owning the hangar, and employing the tow operator-is the ones liable for the damage and 'his' boss should be contacting their insurance company.

Unless your friend has a 'contract' or agreement that HE is responsible for the damages to an airplane under his control-then his boss is violating employment laws-you CANNOT withhold money from paychecks.

So your friend should contact an attorney, or first find out who the insurance company is and pass that information to his boss, and request a refund of all money deducted OR he will go see a lawyer!
