Penal Code 203 (Mayhem) Would this count?

I've been reading the Criminal act of mayhem Penal Code 203. I read that "Every person who unlawfully and maliciously deprives a human

being of a member of his body, or disables, disfigures, or renders it

useless, or cuts or disables the tongue, or puts out an eye, or

slits the nose, ear, or lip, is guilty of mayhem."

I might have committed a similar crime where the after math of that crime was a simple burn mark, BARELY noticeable (even to the victim) Would that count as a Penal Code 203 Offense? Or even a Aggravated Mayhem offense?

-And what are some examples of causes of Mayhem crimes?

  1. Not likely.

    Read the statute in its entirety: "deprives a human being of a member of his body" or "puts out an eye", etc.  They are looking for sever damage causing permanent disfigurement or disability.

    As always, if you have any doubts, ask a lawyer.
