Penalties for sexual interference?

My son is 14. I just discovered that he has had sexual intercourse with our 28 year old female neighbour, twice. He is terrified I will go to the police and that she will lose her children, this obviously is not a concern of mine. I am just curious as to what happens if this is reported? We live in Ontario

  1. Not sure why people don't check to see what Yahoo Answers site they are answering on, as your post is on the Yahoo Answers Canada website and you mention you live in Ontario.

    As such, we do not have felony charges here in Canada, etc etc.  The utmost respect to the answers from members in the USA, but they simply do not apply in Canada.

    In Canada, various sections of the criminal code, from sexual assault to sexual interference/exploitation, etc could be applied in this situation.

    Should you report it a detailed investigation would be conducted, including statements being taken from you, your son, the neighbour, etc.  Child Welfare would be notified (this is not a bad thing and doesn't reflect on you, it is a requirement so that they are aware and can document in case she has committed other offences that they are aware of but that were not reported to police, etc)

    Once all of the evidence has been gathered, a determination would be made whether or not she would be charged.  Whether she would be charged or not would depend on many factors such as her criminal history, the strength of the evidence/statements, whether the Crown Prosecutors will prosecute the matter (as they will not in some cases)...there are a lot of factors.

    If a charge is laid and she is convicted, her punishment could range from a probation order to jail time.  Depends on the a multitude of factors and anyone that gives you a firm quote such as "5 years jail time" etc has not been involved in the Canadian court system!  "It all depends on a lot of factors" is about the best answer.


  2. She would go to jail, as she should. She took advantage of a child. Her kids should be with anyone else, but her. What a sick woman. If you had a daughter who was 14 and it was a 28 year old man would you even ask ? Please report it. It could be my son next...

It's not sexual interference - it's statutory rape (consent of the underage victim, and the perpetrator's knowlegde of the age is irrelevant).  How did you discover this happened?  If you have sufficient evidence, you don't need your son to go forward.  If you go forward, special investigators of your jurisdiction - either prosecutors or detectives - will likely want to speak with your son.

    You need to get your son to be honest with you - it's unlikely that he was the 1st, which means the possibility of sexually transmitted diseases is quite high.  Also, if she's married (or the father(s) of her children are in her life) there is always the threat of violence.  If she's crazy enough to have s*x with a 14 year old, what;s the likelihood that her taste in her other men wasn't as plagued with poor judgement?  Also, try and determine what emotional connection, if any, your son has with this woman.  At his age, he might think s*x an extremely cool experience, but not one creating an emotional bond; if he thinks the opposite, then that bond could be very hard for him to sever - meaning that he'll face some real pain if she decides to move to some other guy.

    You really need to concentrate on 2 things - whether you're sufficiently satisfied that this happened (you don't want to go the "Crucible" route and make accusations that could be true but don't pan out; you also need to educate your son on sexual relationships and sexual intercourse so that he has a realistic idea of what's at risk here.

  4. Can't say exactly where you are. Most places, she gets honked for some degree of sexual assault, a felony, at any rate. And, since these things have a way of getting to child protective services, her kids will be living elsewhere for now, maybe permanently, probably with a relative, with strictly supervised contact.
