Question:

Penalty for posession of weed

I recently got caught with a extremely small amount of weed and small pipe. I am only 15 years old and got charged with smoking paraphernalia and possession of pot in CA. I am going to finally quit but i was wondering what type of probation i will be on. This is my first time getting caught with the police. The officer said something about like an informal probation involving curfews and probably classes. What is it most likely to be?

  1. Wow its nice of taylor B to call the young man stupid. Your a minor so you should be fine. Next time smash the pipe then they cant do anything. And you wont be sent to some school. You really never know what your going to get as punishment, sometimes you will get nothing and other times you''ll get house arrest or some c**p like that.

  2. you'll get on probation for some months to a year.

You'll have to meet with your probation officer.

& maybe get sent to a continuation school.(not sure how they do it where you live).

  3. Possession of marijuana is a misdemeanor under California Health and Safety Code Section 11357. Possession of one ounce (28.5 gms) or less is punishable by a maximum $100 fine.

Possession offenders can avoid conviction by making a preguilty plea under Penal Code 1000, in which case their charges are dismissed upon successful completion of a diversion program. Possession offenses are expunged from the record after two years under Health and Safety Code Sections 11361.5  and 11361.7.

  4. I am curious as to what statute they are alleging to charge "smoking paraphernalia," since devices to use marijunana are not illegal under any law of which I am aware.  I would really appreciate it if you added that to your question.

There are lots of probation programs in juvenile, some of which do not even involve the filing of charges, and most of which result in a dismissal at the end.  Since this is a misdemeanor, if charges are filed you will be appointed an attorney to represent you, who will be better able to guide you.
