Personal injury at work?

recently been injured at work. is it possible to negotiate with company directly or is it necessary to go through solicitor?

solicitor's say i stand to gain 2000 - 2800

what do they stand to make? would they normaly claim their fee from the company i was working for?

  1. IF THE COMPANY WAS WILLING TO NEGOTIATE WITH YOU IT IS A CERT THAT THEY WOULD LOOSE ANY LEGAL ACTION THEREFORE IT MAKES SENSE TO LET LEGAL EXPERTS ACT ON YOUR BEHALF THEY WOULD RECOVER ALL COSTS FROM THE OTHER SIDE


  2. The attorney's fee is a % of any settlement you get.  Your injury is worth what it's worth regardless if you have a lawyer or not.

    It's your decision to hire an attorney.

    It's your responsibility to pay the lawyer.

    The insurance company does not pay the lawyer's fee's on top of the settlement. The lawyer takes his fee from the settlement.

    Think of it this way.....the pie is the same size either way.  The more people taking a slice of it.....means the smaller the piece each gets.

  3. Most solicitors will pursue personal injury claims on a "no win no fee" basis, recovering their fees, if they are successful, from your employers, employers liability insurance.

    Employers liability is a compulsory insurance and if your employers are legal liable for your injury, they should pay the claim.

  4. Mate. I am in the UK. Don't listen to anyone outside the UK as percentage of your claim based fees (known as a contingency fee arrangement) are unlawful over here. The bloke (McBeth) that mentioned a conditional fee arrangement  ("CFA") as "no-win-no-fee" is fairly near the mark. There are some fees you may need to pay if you don't win. There is insurance to cover this as advised by any decent solicitor. If you win the solicitor gets all his fees from the other side. You get 100% of your claim.
