Personal injury settelment?

i was stopped at a light , a full stop when a jerk in a truck hit me doinin about 50 mph, i really hurt my back , and my car is messed up, i have to do therapy for 4-6 wks, then start strenght training, im going to loose my job, does nay one have any questaments on how much ill get after they fix the car and medical bill... ----i guess for my pain and suffering.. he is at fault, thats already established...

  1. You need to let us know where this loss occurred.  Just because you were injured does not necessarily mean you are entitled to monetary compensation.  

    The threshold requirements vary from state to state.  Some are verbal, some are monetary, and others you must sustain a serious injury.  The definition of serious also varies.  

    If you live in a No-Fault state, you may have PIP coverage.  You must file a claim against your own PIP.  This coverage will pay you for your medicals and lost wages.  

    Assuming you are tort eligible, and after you have stopped treating, the claims adjuster will evaluate your claim based on the nature and extent of injury, treatment and disability(total/partial).  You medicals will be included in the settlement if they are not covered by your PIP.  If you lose your job as a result of this accident, you need to provide written documentation.  However, you will only be reimbursed the amount of time you were actually unable to work.  

    Work with the adjuster, and ask them to explain the claims process.  Despite what the prior posted has suggested, the insurance company will work with you, and will attempt to reach a fair and reasonable settlement.  She apparently is dealing with an insurance company that has very poor customer service.


  2. I am sorry - I am currently waiting on $ from the evil insurance company myself - strike that - I'm waiting on PAPERWORK so I can finally get $ - 6 weeks waiting & going strong!  With no end in sight!

    You get the bills for your medical - and in theory they reimburse you.  If you have to sue them - everyone will be reimbursed before you (the lawyer, the DRs your insurance company) see a dime of that $.  

    The good thing is this is all tax free $ - but the bad thing is the insurance company is not your friend & they will not treat you kindly, nor be even hospitable to you - they will also lie to you (told my attorney 6 weeks ago "the check is in the mail" and I've yet to recieve paperwork let alone financial compensation)

    I am $3K in the hole over my accident (not my fault)
