Question:

Petitioning for my fiance' and child ASAP?

OK this is my situation, I've been a legal resident since 95, but the thing is I've broken continuity of my 5 years stay in the states in order to make me eligible to become a US citizen, being that I went abroad to study. In the process, I fell in love and had a child (so cliché...hehe) while I was studying over seas. Now that I'm back here in the states, and have three more years to fulfill of continuous residency ‘til I can qualify to become a citizen, ultimately making me eligible to file for a fiancé visa for my significant other and child living abroad. My question is, is there a faster way of bringing my family here other than becoming a citizen first then filing for a fiancé's visa? Thanks in advance

  1. You have two options, neither is quick. You can marry her in her country now. Come back alone to the U.S. and submit a relative petition for her. The wait would be about 5 years.

If during that five year wait, if you become a U.S. citizen, you can convert the relative petition from "spouse of a permanent resident" to "spouse of a U.S. citizen." That would be a classification that goes much faster.

Or, you can wait the 3 years, become a U.S. citizen and submit a finace petition to bring her to the U.S. to get married. Either decision will bring a long wait.
