as defination given in penal code it is not theft because it is not related to tangible assets. so pirecy = stealing/ theft isn't correct in eye of law.

When corporate houses charge you an exorbitantly high price for a product or a service (which is essential) they call it "Maximising returns and enhancing shareholders value"  

It is not classified as stealing.
