Placing a lien on a house in Ohio?

I had a contract to purchase a rehabbed home and they didn't complete the work that needed to be done properly. The contract states that if they are at fault then I am to be reimbursed my earnest money. Well, it's turned into a nightmare. I still have no actual home, my belongings are now in storage, and he has not returned my earnest money. I was going to take this to court, but he is saying he may file bankruptcy. Would my best action be to place a lien on the house so I'd eventually get my money returned? If so, then how do I start the process? Thanks!!!

  2. Wow you have alot of things going on here.  The best thing to do is to contact  real estate attorney an have him/her look at everything.  They can advise you the best course of action,

  3. You can not legally place a lien because of this.    You can sue him in civil court, but you have no claim to the property.
