Planning to take 2 minor children with me to Philippines for 3 years?

I'm going to study nursing there. I am applying for dual citizenship. Me and their father, my husband are separated right now. I've tried to contact him to let him know of my plans and to send him the consent forms for him to sign and notarize so I can get a passport issued to them.

Do I also have to get a letter from him that is signed and notarized stating that he's ok with me taking our children out of the country?

If he doesn't respond the way I'm hoping, can I get a court order for letting me take the children out of the country without filing for legal separation or divorce?

Also if I provide evidence that I have made attempts to contact him but he doesn't want to respond and I take an oath and get the special circumstances section filled out explaining why I can't get him to sign, will their passports likely be approved? If it will be approved, do I still have to get a letter from him stating he's ok with me taking them out of the country? (U.S.)

  1. I told you that you need to see an attorney who specializes in family law.  These questions simply cannot be answered thoroughly and adequately on this board.

    You don't need a divorce right now, but you MUST get a legal separation from your husband and you MUST get a court order granting you sole custody of the children.  This isn't optional.

    From your other questions it looks like the father absolutely does not care about you and the kids.  If that's the case the odds are he will not respond in court and the judge will give you what you ask for.

    Understand something, you can't just remove the kids from the United States for such a prolonged period of time based on your current circumstances.  You could easily find yourself in serious legal trouble.

  3. With all the good nursing schools here in the States why would you want to go out of the country ? It seems I smell something wrong here.
