Please, I need some help...I have a question about filing for bankruptcy?

I financed a car in 2006. I had no credit history or anything in my name. The reason why I got the car is because my ex-fiance at the time co-signed for me. My interest rate was SKY HIGH..you don't even want to know! Trust me lol So then, I had 2 jobs and even though the monthly payments were very high, I payed everything on time. I started getting approved for credit cards. Then I lost my job July 2007 and ever since then, everything went downhill from there. I started missing payments on my car, my then fiance filed for bankruptcy, and it was a hot mess. I tried going back to the dealership to re-finance my car but they said I have to pay almost 4 grand for all the re-registeration fees and blah blah. I just kept making my payments. My car got repoed last Thursday. I was extremely upset yet happy at the same time. I'm tired of paying 650 dollars every month for a Nissan. Interest was almost 19%. But now, after they auction it off, I am responsible for paying the difference!

  1. Get all your bills together and meet with a lawyer that specializes in bankruptcy. The initial visit is usually free and many here in Fl will work with you on payment. It is quick and easy. You will be approved for loans almost immediately after you are discharged(takes about 5-6 months start to finish). You are young and can recover from this. Bankruptcy may be ur best bet.


  2. I work in the legal field and if I were you I would begin by going to a bookstore and looking up books such as Bankruptcy for Dummies or some other easily understood legal books on bankrupcty. They are usually handled through the federal courts and you have to pay to file for bankruptcy. You want to investigate the laws in your state. I live in Ohio and where I live I would file in the United States District Court here in Ohio. Find what District Court you would file in. Then there are things like bankruptcy trustees...etc. I would definitely start with an internet search and book research such as I already outlined. Good luck.

  3. Check this website out....www.bcsalliance.com...it's a great site about bankruptcy, debt, collections, etc....Someone posted it for me once, and it's a good resource. I could get into detail about bankruptcy. I used to work for a bk attorney....My best advice, Look in your phone book for a good bankruptcy attorney, 2 or 3 of them, call them and see if they will see you on a first free consultation, or one hour free consult. Then...ask them what paperwork you need to bring with you and bring EVERYTHING they ask you to bring. You will need pay stubs, taxes, list of all your bills...this is needed to determing if you even qualify for a chapter 7...Chapter 7 is total liquidation of debts...Chapter 13 is a payment plan set up to take wages out of your paycheck to pay your bills and handles by a trustee of the courts. Sometimes an attorney will retain if you can come up with the payment to retain them....ask them how....they will tell you what you can get away with not paying so you can pay them and retain to them.
