If this is true then all law obeying citzerns give up now. Its seems if a career criminal or anyone attacks you, you better not fight back, incase you kill them accidentally

  2. This is just the latest in a long long line of stories like this where law abiding citizens and victims are treated as criminals.

    And to Ed, the notion of reasonable force is a fallicy. How can it be decided in the cold logical thought processes of people who a) have the gift of foresight and b) tend to be liberal 'force is never necessary' idiots, that the force that was used when the victim was in fear of their lives or had to defend themselves with adrenaline pumping?

    Also, as an ex soldier and trained martial artist, my idea of reasonable force would be very very different than a middle aged woman doing her weekly shopping. You get my point?

    The whole law is ridiculously lax on this point, and is the principle reason why so many people commit violent crimes, because they know the law is on their side.

  5. If you are in fear of your life (IE attack by an armed criminal) you may kill him/her in order to protect yourself under the law.

    But if you are able to get away or used excessive force (IE against an person who just pushing you who is provoking you) then you will be prosecuted for something manslaughter or something like that (guessing at what one will be charged with)

  7. Note that this story does not say the man WILL face a murder charge. It says he COULD face a murder charge. The CPS decide what cases go to court. "Reasonable force" is an accepted legal defence against an attack or attempted murder. How much force is "reasonable" is for a court to decide, if it gets to court.

    If the CPS think his response was "reasonable" then he won't be charged.

    This hinges on how many times he stabbed his attacker. If he disarmed him and stabbed in once or twice in the struggle, that would be reasonable, even though it proved fatal.

    If he disarmed him and stabbed him 200 times, that's a different matter and shows a different, sinister intent.

  10. do-gooders have a lot to answer for. i believe we should find the originators of the criminal protection laws and make each of them suffer like real victims have.

    i assume most of the do-gooders are connected in some way to social services, thereby guaranteeing anonimity/protection.

  14. Wow, guess the US is not the only messed up country.  I dated a cop once who told me that if I was going to shoot or stab anyone while defending myself to be sure and kill them or they would sue me for everything I had.  Guess that doesn't apply where you are.

    We were also told that if someone breaks into your home and threatens you and then runs away, if you shoot at them you will be charged because the person is running away and poses no more threat to you so you should not shoot at them.  However, if he's in the house and attacking you, it's okay.

    Unreal.

    this was what a cop told me to do.

    waste them. bag them. and bury them. DEEP.

    let the cops wonder what happened to them.

    look how many people disappear every year.

    and how many dopers between 18 and 35 with long criminal records are never seen again.

    i live in a rural area and the neighbors will call before calling the cops.

    one will even loan me his backhoe if i need it.

    he was shot in the leg a few years ago by a criminal stealing equipment from his farm.

    now he uses the same rule.

    for those that the cops get first we file a restraining order with the court that forbids them from ever coming within 20 miles of town again.

  20. A man died, so the police can't just let it go. The CPS will look at the case and decide not to prosecute. A verdict of accidental death or death by misadventure will be recorded and that will be the end of it. But the law must be seen to be done. The police can't just choose not to prosecute without following the correct procedure.

I had to call the police out 2 weeks ago tonight, It was 1.30 in the morning and I heard a bang and the dog barked, then I heard a noise as if someone kicked my garden gate at the side, locked and  bolted, so the dog started barking like mad, when they came out which was 15 later, that was quick, I let them in and then out the back to check, they saw that I had a big knife near the front door and one at the back, the policeman just looked at me and smiled. If someone did break in I would do as much harm as possible and I know some might say I wouldn't stand a chance, I would cause they would be trying to get my little Yorkie off their leg so plenty of time for me. What could they do I'm a 50yr old woman 5ft 2 and thin, I rest my case.!

I was alone one night when two guys approached me, one had a knife, and threatened me with it, I told him to put the knife away, or I would stick it up his ****, next minute he tried to lunge forward and stab me, I beat both men to a pulp, unfortunately two cops were sitting in a car opposite and saw me attack these men. I was charged with grevious bodily harm, because the prosecution had learned that I had done boxing for many years. The force that I used was seen as excessive, despite one of the men yeilding a knife, I was sent to prison for one year.

    Just glad I left that country that has gone to the dogs four years ago, and live in the US.

    I used to be very patriotic towards England my country of birth, not any more, it sucks, and so do many of the so called crazy laws.

    I should have just stood there and let this guy stab me, and maybe called out for help, or if i was carrying a newspaper I could have slapped him a round the head with it.

    I wish you luck my friend, but do not see any recovery from the down hill slide.

    I believe that if you break the law deliberately, then you should not expect the law to then protect you. You rejected "The law" in the first place, no crawling back with your tail between your legs if something goes wrong.

  27. If stories like this annoy you, then don't read the Daily Mail. It goes out of it's way to wind you up and make you cynical. It does it deliberately, and you can generally see the flaws in their arguments. However, by the way it's presented, you gladly gloss over the flaws and passionately accept that you're in a mad society with no moral values. But then, Daily Mail writers are all too pleased about that, as they proudly boast headlines like: "Britain: Drugs capital of Europe!" "Britain: Teenage pregnancy capital of Europe!" "Britain: Binge drinking capital of Europe!" "Britain: Gun crime capital of Europe!" - Sound familiar?

    The story they're reporting here is that someone killed someone, and they're going to court because of it.

    I think that's good. I'm sorry that the guy is put in this position, but if you were able to kill someone, even for a really good reason, and not go to court, then there would be a terrible situation that is open to abuse by knife wielding thugs, cold blooded murderers, gangland criminals, etc. who can justify their brutalities by claiming self defense.

    If the man didn't use unreasonable force, he hasn't committed a crime, and will walk free. It would be wrong not to take this to court to make sure that he didn't use unreasonable force, and that his story is what he says it is. We all find ourselves in situations from time to time where we have to realise that, even if it's through no fault of our own, we're not just going to be able to walk away from this without it costing us anything in the way of time, money, inner peace, etc. And for this guy, this is one of those situations.

    But don't get wound up by it. Just stop reading the tabloids, since it's probably the presentation of this story that's annoying you!

    I once read in a book and it said, "No one in their right mind would ever trust the British Judicial system". Looks like it is very true.

    Protecting yourself if attacked by a harmless knife carrying criminal is just not on.
