hi a friend of mine was in a relastionship with a man from dubai, she is from australia they had a child together, both their names r on the birth certificate. The father moved back to dubai 1yr ago. my friend and their baby have gone over to visit him, and apparently he is sayin he is keeping his duaghter ther with him. just wantin to know would he have more rights than the mother over in dubai??? hope i havnt made this to confussing

  1. There are a few movies about this subject. Made from real-life events. When you marry an arab those are the risks you take. Either she's stuck in Dubai so that she can live with her daughter or she's going to have to leave the country with her without telling him. You didn't say if they're divorced or still together and why she went to see him. He probably convinced her to go and now that she's there he has his daughter and knows she can't do much about it.


  2. Yes, absolutely, under Islamic law that kid is his and it will stay with him as long as he likes.  She has no rights to anything.  The Australian embassy will not be able to do anything for the mother or the child.

  5. As others have mentioned, this is a common problem and one that women would do well to check out before they become mired in it.

    The UAE is not a party to the Hague Convention on International Child Abduction; custody decisions are based on Islamic (Shari''a) law.  It might indeed be very difficult for your friend to get her daughter back.  Here is information prepared by the US embassy in the UAE.  Since your friend is Australian, she should check with her own embassy to find out what assistance - if any - they can provide.
