  1. I've done NVQ level two in care and we covered confidentiality quite extensively.  Basically, only the people with a need to know the information in a file have the right to know.

    You would break confidentiality if the information you held needed to be shared with a colleague or superior for health and safety reasons,  the clients'/yours/other people's.

    I work with the lederly and obviously some scenarios are different to a nursery setting but I should think that the framework of the law is the same for both.


  2. The 1998 Data Protection Act came into force in March 2000 & replaced the previous act. It asks anyone processing personal information, such as financial records or details to register with the Data Protection Committee. The previous act covered only the processes of information stored on computer, whereas the current act applies to paper based records as well. Anyone processing personal data must comply with the eight enforceable principles of good practice below:

    Information must be:

    Fairly and lawfully processed

    Processed for limited processes

    Adequate, relevant and not excessive

    Accurate

    Not kept longer than necessary

    Processed in accordance with data subjects’ rights

    Secure

    Not transferable to other countries without adequate protection.
