Please help ebay**HELP**

Question

I bought a pair of Nike Shox R4's, but they are FAKE. So can I report a claim on paypal and still keep the shoes and get my money back? I paid 60 dollars. Thanks Also if they are fake what kind of trouble can he get into? thanks

If they are fake then the seller could be thrown off of ebay, I would also report the crime to your local police office.

Disputes for Non Receipt and Significantly Not As Described items must be filed within 45 days of the initial payment.

To file a dispute for a transaction sent through PayPal please follow these steps:

Log into your account at https://www.paypal.com/.

Click "Resolution Center" at the top of your Account Overview page.

You will have the option of:

Clicking the "Dispute a Transaction" button, or

Clicking the "Report a Problem" tab and then clicking the "Report a Problem" button.

Select "Item dispute" and click "Continue."

Click the "Find transaction ID" button to display your history.

Change the dates in the drop-down to find the transaction and click "Search."

Click the transaction ID.

Click "Continue" and follow the instructions.

Please do not mail or email your dispute, as it causes unnecessary delays.

Any time within 20 days of the date the dispute was opened, it can be escalated to a claim with PayPal. Otherwise, it will automatically be closed after 20 days have passed. If the dispute is escalated to a claim, PayPal will investigate your claim and make the final decision. Recovery of the full transaction amount is not guaranteed. PayPal will seek to resolve your complaint within 30 days from the date your complaint is filed, however, more time may be needed.

To escalate your dispute to a PayPal claim, please follow the steps below:

Log in to your PayPal account at https://www.paypal.com/.

Click "Resolution Center" at the top of your Account Overview page.

Select "Open Cases" in the drop-down menu and select the dispute you wish to escalate.

Click "View" under the Action column.

In the "Close or Escalate" box, select the button that will escalate the dispute to a claim.

Click "Continue."

Complete the "End Communication and Escalate to a Claim with PayPal" form.

Click "Escalate to a Claim."

You should immediately file a claim with paypal or your credit card company. (however you originally paid for the shoes).  I would also submit a claim to ebay.  Ebay will shut the seller down if they are selling fake items and claiming them to be a name brand.  I would wait to see what paypal and ebay tell you to do with the shoes.  I don't think you would be able to keep them.

first and foremost, contact the seller. both paypal and ebay will insist on that.

second, shame on you for trying to get your money back and keep the shoes. trying to scam the seller for scamming you.

third, expect to pay for return shipping yourself. maybe not. but it is a good bet.

fourth. if it sounds to good to be true(like super a price for genuine shoes), it probably is.
