Please help me, im getting sued!?

Im 23 years old, and about 3 years ago i was involved in a minor car accident in which the lady hit me, but eye witnesses told the cops that i hit her. So i was unfairly deemed at fault. Keep in mind, the accident happened in a rural neighborhood where the speed limit is only 20 mph and the damages were just a few small dents on her car and a big dent and scratches on mine.

Well, she hired an attorney and they requested $95k in bodily damages, but never gave my insurance company any medical reports. So my insurance company offered her $8k to settle. No response. Many months past with no contact from her or her attorney and about a month before the statute of limitations(?) was up my insurance company got a call from a new attorney saying that he was representing her now. Well my name is on the lawsuit, so I got served papers.

Can anyone tell me whats going to happen from here on out (in general)? And if so, can I get sued for all the money in my Roth IRA and bank account? Are there legal ways to hide it? Please help me im stressing out because i dont want to lose my savings.

  1. It depends on how much insurance you have.  Talk to your insurance company.  Then if that does not solve you problem, see an attorney for a free consultation.  Hopefully, the insurance company will pay for one, but work with them.


  2. Notify the insurance company you had at the time of the accident; notify the insurance company IMMEDIATELY and fax them a copy of the papers you were served regarding the law suit.

    They will assign you an attorney and s/he will take it from there...so, don't worry...but you want the insurance attorney to do your talking for you...if anyone contacts you on behalf of the plantiff (the other lady) tell them to contact you attorney.

    What you are going through, based on the story you have told, has all the ear marks of a common and  a typical scam: a ploy by the other party to get some money out of the deal and a greedy attorney she has found who is, obviously, willing to work the system for his cut of the action.  

    Good luck and try not to worry about these things which are beyond your control; it's the insurance company's problem...this is why you paid them all those premiums.

I would not worry about it, leave it to the insurance company, doubt she will get anything what she is after if she can't provide medical documents from that date stating her injuries, insurance companies are not stupid. Whether they serve you papers or not its still down to the insurance company as you were an insured driver, most likely she will end up with nothing more that a bill for her lawyer if she keeps turning down compensation offers.

  4. Lovely! You, a stranger in a rural area, and you had a little fender bender!! The witnesses! Of course! they were natives to the area!! It's always the OTHER guys fault!! That's you! p***y cat!! Why did she wait 3 years to decide to sue you!??? Bodily damages on what!? HER or her blooming car!?? OK! So now we start at the beginning! Number one, how much damage was done to YOUR car, and did you have it repaired? She never gave your insurance company any medical reports, what about the first attorney? Didn't HE say what kind of injury the "lady" had!? On top of this, she and that attorney didn't respond!! This lady is a scammer! How in God's name is she going to prove anything! First thing, get hold of your insurance company and go over ALL if any paperwork you guys got from the first attorney! From your questions as to do with your personal money, is this a CIVIL SUIT!? She HAS to show evidence of an injury, doctors reports, and check those so-called witnesses!!  I know most insurance companies will go settle instead of wasting time in court, but, if I was you, I would insist they DO go to court, because her suit is a bunch of c**p! See if you can find someone to check HER driving record, other accidents she may have got into, and what she did with them! I know people who take the OTHER guy for a ride for a living! Also,don't forget the police reports!!! The names of the witnesses should be on them! Hire a private investigator - it will cost a little money, but it might be worth your while!

  5. Nothing will happen... It is still your insurance company's case and regardless of what she and witnesses say, the evidence will speak for itself...  Was their a police report?  If so, then make sure the insurance company has that and the insurance company still represents you...  That's what insurance is for!
