Please help me with my e-bay dilema

I sold 60 DVDs on e-bay a month ago and the buyer has just contacted me to say that some were missing and some were scratched. We did list them as second hand but as for them being missing, we checked every single case and they were all there for sure. He wants to resolve before contacting e-bay. What would happen if he contacted them? Does he have grounds to claim all his money back? Whould he get to keep them aswell?

  1. I had a similar situation recently; I sold a Sony PSP "as is" and gave a description of it, including the minor scratches on the screen. It was purchased for $80. When the buyer contacted us to say the screen was unusable and the buttons were broken and/or missing, we replied that the unit didnot have those conditions when we sent it. The buyer said he wanted his money back and we said "Fine, send back the PSP and we will refund it", the buyer dropped the complaint.

    So, I'd say stick to your guns, and if they ask for a refund wait til you get the DVDs back.


  2. He wouldn't be able to keep them if he requests a refund on his money.  He would have to send them back, at his expense, in the same condition as you sent them out.  Do NOT refund the money if that is his request until you actually have them in your possession again.

    As for contacting eBay, I would contact them.  He should have filed a complaint to you as soon as he recieved the package.  A month is quite a bit of time for him to contact you about this.  I would explain to them what is happening, and ask them what they think.  That is what eBay support is there for.

    As I said before, he won't be able to keep the dvd's if the money is refunded.  He may be trying to scam you.  It has happened before.  Make sure you do not refund a single cent until you have the dvd's back.

  3. Hmmm....There are a lot of eBay scammers out there but for now it's your word against his (even though you know they were all in there). He has no grounds in terms of them being scratched as u listed them as second-hand but it would probably be wise to contact eBay directly to figure out the best course of action. Good luck!
