Please help on car accident incident?

last night i was driving striaght to my way. i had red light so i stopped. Then after i started to go on as my light turned green. As there was upcoming traffic from other side and they have left turn. They have green yield sign and they do show arrow too. But what happened was i was on my red light. So as soon as, it turned green i started to go on. But the guy coming from next side even didnt realize his sign was yield. i was almost gone but he came and hit me on as i tried to avoid him. My speed was barely 10 mph. after that cops came in but he didnt gave anyone ticket saying our statement doesnt mind as we both told him eachother light was green. But later on he said me he would put him on fault as it was his responsible to yield. so now can you suggest what to do? i've liability insurance so do i need to hire attorney or talk to them myself? what are the chances for getting in my favor.what should i say insu. adjusters? it happened on houston texas n he has old county mutual insu

  1. If I read your statement correctly....

    1.  straight has right of way

    2.  you cannot enter an intersection under a yellow unless it is unsafe to stop (not enough time to stop safely) (can't lock the wheels up or through your passengers around just for a yellow)

    So it sounds like you'll win.....

    Then take him to small claims and settle it there

    Go to the police station and ask more questions

    Small claims should work.....depends on your states laws......In michigan you can't sue for car damage....$500 LIMIT

  3. Yes,  it is his responsibility to yield to you as he was turning left.  

    Yes,  it is your responsibility to wait and not move until you are sure it will be safe.    You need an attorney only if his insurance balks at paying to fix your car.

  4. First, call your insurance company.  They'll have you give a recorded statement.

    You could go with a friend to see if the light is timed wrong.  Sometimes both sides are green at the same time.

    You're lucky that he hit you, and that you were going straight and he was crossing your lane of traffic.  It sounds like the other guy either tried to sneak the light, or wasn't paying attention himself.  It's also good that the cop is going to fault him in the report.

    Everything seems to be in your favor.  But it's possible that the other insurance company will say that you're partially at fault.  If, for instance, they say you're 20% to blame, then they'll pay you 80% of the cost of your repairs.  You can negotiate with them on this, though.  Threaten to bring them to small claims court to collect the rest of your losses, and see if they won't throw another couple hundred dollars your way to save themselves the trouble.

    EDIT-- You shouldn't have to take the other driver to court.  If he has liability insurance (and all drivers are required to), then his insurance company should take care of you.  The purpose of mandating drivers to have liability is to cut down on car-accident-related litigation.  Court is only necessary if he doesn't have insurance (which probably means he doesn't have a nickel to his name), or if you think his insurance company is giving you an especially raw deal.

    EDIT -- If it turns out that the guy who hit you is not insured and neither your insurance company nor his will take care of your damages, then you DO have to go to court to collect your losses (unless the guy just agrees to pay you).  The cutoff for small claims court is different from state to state, but it's typically around $5000.  You can represent yourself in small claims court, but you should get a lawyer if you're suing for more.

    Unfortunately, as I said earlier, if this guy doesn't have insurance, it's quite possible that he's so poor that suing him will just be a waste of time.  You could be out of luck here.

    *You're at a red*

    *Oncoming traffic has green and a green left turn arrow

    *That light went off and your light turned green*

    *You went, but the person turned left trying to beat the light and then hit you*

    Seems like you are in the clear. I would also recommend you call your insurance company.

  6. You do not need to hire a lawyer.  Tell your liability insurance company and let them decide whether to pay, fight, or negotiate.
