my family had a whip round for my 60th birthday. so i went to comet electrical store and bought a laptop it was not the best of makes £350. when i got it home and set it up it was very slow. so i decided to take it back two days later and told them it was not what i wanted. can i have my money back the manager said yes. i`m on disability and have a bad heart then came the very bad upset he told me i would have to pay £35 pounds becouse i had opened the box and they could not sell it again. this really upset me and they took it out of my card account. please who do i contact.

  1. Try the Citizens Advice Bureau first because honestly this doesn't sound right to me at all. The can still sell it in another box. Then if no joy with them, tell the store you are not happy with being treated this way, and will contact the TV watchdog to see what their advice is. Put pressure on Comet, do not let them fob you off. The CAB should be able to advise you in any case.


  2. im not sure but did you explain to them that it was faulty if not go back and tell them it was faulty as they can reclaim the money from the company who makes the laptop

  3. The poster who says that Comet can resell the laptop in another box are wrong.  It is illegal to sell the laptop as new.

    When you went to purchase the laptop did you seek any advice from the Comet staff?  If so, did you explain to them what functions you wanted the laptop to perform?  If so you may have a claim that the goods were not fit for purpose - i.e. they didn't perform the functions you had specified at an acceptable speed.

    However, if you went to Comet and chose the laptop yourself without any assistance from Comet's staff, then they have every right to charge you - if you had taken the goods back in an unused condition then I am sure they would refund you the full amount.  Would you expect to be able to go and buy a brand new car, drive it for 2 days and then decide the engine wasn't powerful enough for your requirements, take it back and get a full refund?  No, because the minute you drive that car off the forecourt it becomes used, instead of new.  The same thing applies when you purchase a computer/laptop - the minute you turn it on and accept the licensing agreements the computer becomes used.  In addition, the s/w license you will have accepted can't be resold.

    Whilst I sympathise with the fact that you are on disability, this has no bearing on your purchase or your entitlement from Comet at all, as they are not going to discriminate against you in this situation because of your disability.

  4. If it is faulty then you are entitled to e refund under the 1971 Sale Of Goods Act.

    However, if there is nothing wrong with it the shop are not obliged to do anything. They appear to be taking it back as a gesture of good will. As the box has been opened etc. they can't now sell it as new so they are giving you a refund minus 10%.

    It's the best deal you are likely to get, considering they don't have to give you anything.
