Question:

Please help with my apartment lease question.. Am I being played here?

I signed every paper of a lease to a student housing apartment that I thought I was going to be moving into but decided against it so now they are telling me that I have to pay rent for them until they are able to find someone to take over my lease.

The only paper I didn't sign was the guarantor agreement which states if I don't pay the rent the other person who signed the agreement must pay rent for that month.

So my question is......since I didn't get this gurantor agreement signed by another person do I still really need to pay this rent? Since I didn't technically completely fill out all of the lease forms?

  1. most likely you'll be required to pay.  The first hint is the "student housing apartment".  They will have very strong leases that won't give you much of a way out.  As you can imagine, they deal with people who change their minds a lot.  So, they will have agreements that provide multiple (I say again...multiple) ways to make you liable.

    It's likely a pretty standard lease that says if you don't occupy the apartment you're still liable for the total amount of the lease.  You can "satisfy" that requirement by either a) finding a qualified sub lessor, or b) having the owner do it for you.

    In some instances they won't allow you to find your own person.  

    Bottom line:  If you signed a lease, you are bound to pay the monthly rent unless they release you from that obligation.

  2. YES, you're liable.

    You made a contract, you gave promises and you signed it.  You are legally BOUND to pay rent for the full term of the lease; they're being nice if they'll let you out if/when they find some one else.

    The guarantor would be for some one else to pay if you didn't pay, and luckily no one is being stuck for your actions.

    READ what you signed.  You're supposed to be an adult, able to make promises and contracts and fulfill them.  You can be held to what you agreed to.  

  3. It sounds like you DID sign the actual lease itself, which obligated you to pay rhe rent.  Once you sign a contract, changing your mind doesn't get you out of it.

  4. you didnt sign it all, but you did sign the most important paper.  And you dont need the other paper to have a lease.  So, technically, the land lord can just say that there is no other paper to sign.  So, yes, you are liable for the rent. But, I dont see why you should ask this question, because you did sign the lease, and so you are competely wrong.  You know youre wrong, but want to be right on legal papers.  In this instance, you are wrong morally and on paper.  

  5. If you signed the lease agreement, you are obligated to follow ALL the terms of the lease.  The guarantor agreement has nothing to do with this.  It all rests on the lease agreement.

  6. If you are over 18 years old, you are legally bind to the lease that you signed. Why can't you move into the apartment? I hope you do have a good reason. Being an adult mean also being responsible, too. The guarantor agreement is just an extra form for the student housing to protect themselves in case you fail to pay rent because you have no/low income. It doesn't need to be signed to make the lease form complete or legal. Now try to find a new tenant to take over your lease so you can be out without penalty. Good luck.
