why did mary queen of scots not get the england crown and why elizabeth?

  1. Because Henry the VIII left three heirs:

    Edward

    Mary and

    Elizabeth

    Edward died at the age of 16 with no heirs so his sister Mary became Queen.  After Mary Died without heirs their sister Elizabeth became Queen

Mary was not next in line and Elizabeth had the backing of the protestant nobles.  Her son James I was given the heir to the title due to Elizabeth not having any childern.  Mary was a problem for Elizabeth as she was both a soverign head of country and a traitor to her own.  If she had her beheaded, she would then say it was o.k. to behead a crowned monarch.

Mary, Queen of Scot was Henry VIII's grand niece, which means she also had claim to the English crown, but her claim is a bit distant compared to Elizabeth I. Mary's claim to the English throne came from her paternal grandmother, Princess Margaret Tudor (Queen Consort to James IV of Scotland). Princess Margaret Tudor was Elizabeth's elder aunt, her father's eldest sister.

    Under the ordinary laws of succession, Mary was next in line to the English throne after her cousin, Queen Elizabeth I, who was childless. In the eyes of many Catholics, Elizabeth was illegitimate, thus making Mary the true heir as Mary II of England. However the Third Succession Act of 1543 provided that Elizabeth would succeed Mary I of England on the throne. The anti-Catholic Act of Settlement was not passed until 1701, but the last will and testament of Henry VIII, (given legal force by the Third Succession Act), had excluded the Stewarts from succeeding to the English throne.
