Pool fences in Moreton Shire, Queensland.... Any idea of requirements... please ?

purchasing a house.........no current pool fence.. Is this illegal.

  1. different for all states but I believe it is now legal in Queensland. Call your local council nad they will give you the regulations. Even a pool shop should know them


  2. No, I don't think it would be legal.

    You'd need to be careful of that vendor.

    Are they cutting corners elsewhere?

Ah, this is a tricky one, but from memory, that was changed about 10 years ago, houses built before a certain time that already had these types of thing were exempt, you better ring the local council or get on to their website, all councils have one, most probably get some information there.  I was under the impression that the fence around the pool could no longer be the perimeter fence, if that makes sense to you, I remember my mum had the same thing with a house and she had to install locking security screen doors on all downstairs doors and security screens on the windows (so toddlers couldn't get out) even though she had no toddlers, good luck with that.

    Different rules may apply to houses built:

    Before 1 February 1991  

    Between 1 February 1991 and 29 April 1998  

    Between 30 April 1998 and 30 September 2003

    Edit: more info:

    In the QLD Pool Fence rules, about pool fence exemptions, there is a bit that says: "If the need for the exemption ceases to exist, it is mandatory for pool fencing to be reinstated, fully compliant with the nominated standard"

    This indicates that some pools will not be fenced, and I suppose the property could be sold without a pool fence, but the new owner would need to put one in quickly.

  5. The Moreton Shire merged with the Ipswich Shire Council in 1995.  As I live in the Ipswich Shire the answer is yes you do have to have a pool fence.  Check it out with the council the only exception would be if you are on acreage.
