Possible jail time???

I have a friend who has a court date coming up for attempting to aquire drugs by deception. He has never been in any trouble b4 at all, so his record is completely clean. I was just wondering, where this is his first offense, if somebody could tell me what he might expect to hear in court... I mean as far as jail, fines, or probation.

I'm not looking for any smart *** comments, so if ur life is really that boring to where u have to get on Yahoo Answers and run ur face, then I deeply apologize. However, there are ppl who have serious questions and are looking for serious answers...So move on if ur here for any reason other than that. Thankyou for ur understanding!

  1. Without knowing the specifics, its hard to tell.  Penalties can vary based on state, even county.

    In general I would suspect that probation and possible a drug rehab program would be the most likely outcome, as well as a suspended license.  If, however, they determined that the intent was to sell as opposed to use, then yes, jail time is a possibility.

He could, but with it being first offense, his best thing to do is to play the addict that really needs help bit and it will get him maybe some classes or short treatment and probation.  He has to tell them what they want to hear even if it is embellished a little or alot!  Get a fast talking lawyer and pay him!!!

It really depends on the judge - and where he is at.  If he is young, he may just get probation and drug counseling.  Depending on the level of crime (misdemeanor, D felony), he may be able to get what is called a deferrment - that is where his record will be clear after he successfully completes probation.  I have no idea about the amount of fines, but he will likely just get court costs and probation fees.

    Deception, what he wrote an illegal script? He went to a bunch of different doctors to get narcotics? He went to a bunch of different drug stores and told them he had a cold to get ephedrine? What?

    Be more specific.
