Possible outcome of breaking and entering charge?

My husband was just charged with breaking and entering - however, the crimes occured while he was a cocaine addict. Since then, he has gotten treatment and has been clean and sober for almost a year. He doesn't even remember committing the crime - that's how addicted he was. According to the police, he broke into a gas station twice and stole approximately $400 (combined). My question is - what is his possible sentence and will they take into account the fact he was a heavy cocaine user and alcoholic at the time, but is now clean and sober?

  1. Being high isn't a defense.  


  2. If he has no priors they will definitely take it into account.However if he already has a criminal record and they see a pattern,being on drugs at the time will not make a difference.

    My brother had a similar situation of breaking and entering,and tried the being high defense but he already had a burglary of a vehicle on his record and received a 10 yr sentence.He pulled 20 months on it.He is out now and on parole.Good luck.
