Question:

Possibly getting evicted. What do I do?

My 7yr old daughter gave two older boys (10 or 11) in the apt complex her nail polish because they said they wanted to paint their nails. The two boys decided that it would be cool to write , with the nail polish, curse words on my neighbors (daughter's, boyfriends) car parked out front. I think my daughter might have also did some damage to the car but not the writing part. Maybe some scribbles or something. I didn't get to see the car. There were no witnesses. I asked my daughter, and she swearers she only watched them do it. The police are now questioning me and want to talk with my daughter. The police said there was no damage and that they were able to get the nail polish off ok. I explained that it was kid play nail polish (comes off in like a day on fingers). Could they be lying that there is no damage so that no one gets scared about the cost of the repairs? The police have not spoken with the other two boys yet. The biggest problem is, is that the complex will be notified upon the outcome of the investigation and I really don't know if they they will evict us or not. I don't know if it even matters whether my daughter did any of the damage on the car or not. They will be here tomorrow to start the questioning.

I don't know what to do or how to handle this. HELP!

  2. Oh I highly doubt the complex will evict you. They want your money every month, and you didn't do any damage to THEIR property or name.

    You might just have to pay for any costs the car needs.

    I wouldn't worry so much.

  3. The cops could be lying but it seems unlikely.  Your daughter can refuse to talk to the cops, but whether that is wise is debatable.  On the eviction, my ability to tell the future is off today.

  5. First off, Never trust the police. Do Not let them talk to your daughter alone or in your presents. To evict you the complex must have due cause. If there were no witnesses unless someone makes a deal to snitch, there is no case that I can see here. If the police want to speak to you or your daughter again tell them you would like to have an lawyer present before any more questions are brought forth. That should stop them cold in their tracks. The police will and do lie to get information. They will all say this never happens but it's a common tactic used and one of those wink, wink, understand kind of things. If the complex should try to ask you to leave, have them provide you with a copy of your lease and to highlight the things you are in violation of and to provide an additional copy for your lawyer. Now if you are in clear violation of one of their rules, then I'm sorry but you'll have to leave, but the burden of proof is on them. Sometimes if you show them you'll fight they'll back off. When your in their place they make money, when your not they don't till they rent it again. The police sound to me like they are trying to get your daughter to tell on the other kids. It's up to you weather or not you cooperate, but never,NEVER trust the law.
