Power of Attorney and Mother-In-Law?

My husband and i are getting a sepration. He is over seas living and Im here in the states. Can he get his mom a power of attorney to take the car that has a loan in his name away from me? What about before the seperation, can she take the car away from me?

  1. Marital property cannot be touched without a court order.  She can act in his stead but the court will decide what happens to the marital property.  If she takes it, she is stealing it and you should call the police.  Make sure you ask for the car in your divorce papers.  


  2. A court order is require for property separation. With power of attorney, she can appear in court for him and accept any property that the court assigns to him. She cannot seize any property without a court order.
