Private Surrogacy Process (mom2b has ?) Please help!?

So, my friend agreed to be my surrogate mother. We are "well off" enough to afford a child, but not $ enough 2 adopt or get infertility treatment. (Thus, why we are doing surrogacy.) My question is this, after she gets pregnant, can we just write out a relinquish-of-custody contract and get it notarized, or do it in front of a judge, or do we have to go through the entire adoption process? Because we cannot afford $10,000- even IF we get a stupid tax write-off. All we want is a baby, and if my friend is willing to do it then we should be able to do it. so...someone please help i cant find anything on the Internet that pertains uniquely 2 our situation. thank you.

  1. This does not seem legal in any way to me.  

    I know that people do surrogacy pregnancies, but usually those are done well in advance of the pregnancy, and a contract is drawn up with all parties involved signing.

    I just don't know what will stop her from not keeping the baby once it is born, especially if she is the biological mother.  

    I don't mean to sound mean, but this doesn't make sense to me, and you seem to be setting yourselves up for some messy legal stuff in the future.


  2. I think it would depend on the state you live in, and the state the surrogate mother lives in.  I think it would be risky to attempt to do this without some advice from an attorney.

  3. First of all you need to talk to a lawyer who specializes in family law in your state because the laws are different in each state.

    Is you husband going to be the biological father of the baby? If so then most likley, your friend will simply sign over custody to your husband, sign away her parental rights freeing you to adopt the baby (so that you are legally the mother). All of this will require some money but no where near $10,000.

    If your husband isn't the biological father, then yes you guys will have to adopt it, but if she signs the baby over to you in a private adoption all you shuld have are lawyers fees which again will not be anywhere near $10,000.

    No matter what tho, to get the baby yours legally, you will have to go to family court and have a judge delcare you and your husband the baby's parents.

    Search around for a good family  lawyer, the expense shouldn't be too bad since all 3 of you want the same thing.

  4. I don't think it's legal to sign a contract or any termination of parental rights until AFTER baby is born at which time the parent who is not the biological parent will need to adopt the baby

    Have you given any thought at all the the effects on a baby that is separated from his/her mother at birth?  Or do you even care, as long as you get what you want?  I find this whole thing really really sad.  Please take a second to watch this short video:
