Question:

Probation Discharge?

I have a question on how the whole thing works and if someone has been there before can answer this question, that'd be great. My offical release date was July 23, 2008. As far as I know I am still on probation. I finished my community service right away, served my jail time, never got in trouble being on probation, and have chiped away at my fines (noted I still owe some) does still owing the state mean until my balance becomes a zero mean I will be on probation? Any help is greatly appericated. Thanks.

  1. I would just call and ask.  Your PO should have told you if you were off or not.  I know you ill receive a letter in the mail stating you're off probabtion but that could take a while....I would just ask them if I were you.

  2. If your expiration date is July 23, 2008, then you are officially off of probation.  The only exception would be if your PO filed a Motion to Revoke for not paying all of your fines and fees.  That motion would have to have been filed prior to July 23, 2008.  So, it is possible that this motion has been filed, you just don't know about it.  However, in my experience as a PO, I usually did not file if it was just money ... unless of course you owed restitution.

That being said, there is still a way that the Probation Department can get you to pay and that is by turning your outstanding fines and fees into a civil judgement.  If that happens that allows the probation department to go after your tax refunds, and depending on how active their collections department, they could even get wage garnishments.
