Probation Violation Detainer Hold In Phila Pa?

My husband is being held on a two10 year old Probation Violation in Phila Pa CFCF for not reporting.

Is it true that they you must see the judge with-in 30 days on a detainer??? Or do thay hold you untill you see the judge on 8/27/08

Or can another judge lift his detainer he has court on7/21/08.

His first judge reinstated his probation Which is great I hope the others will do the same. That what my lawyer siad they will do. I looking for hope that he will be home soon.

  1. This can be highly jurisdictional. In Ohio, where I am, a probation violation must be dealt with in within 270 days ( 9 months ). Quite often, a violator will sit in the county jail for a bit just as an attitude adjustor. I dont see that in a ten year old violation however.

    This would be a rough one to try to call however. They  are going to look at what he has done over the last 10 years (PSI report will do that) and decide how best to deal with it.

    Your lawyer is basically correct. You can only hope for the best on this one and wait.
