my friend is on probation, and as terms of his probation, he was ordered to pay $705 to the court. basically, he can't make the entire payment. this is basically what has happened.

1. jailed

2. given conditional discharge

3. conditions of discharge not completed

4. put on probation

5. he completes all probationary conditions except for part of a $705 payment

if all the terms of his probation are completed, except for some of that big payment, what do you think will happen, judging from the events that took place before?

  1. jail, bring a toothbrush and say hi to bertha......

seriously you need to speak to the probation officer --- try cutting the cigarettes, pay tv, alcohol, hair cuts...... or mow lawns walk dogs do anything to get the monkey off his back....

  2. As long as he making an attempt to pay restitution and complies with all other conditions, he will be ok.  Good luck.  Prisions are so over crowded, just make payments and don't think you can get away with not paying.  Then probation or parole will be revoked.

  3. he needs to talk to someone about the 705 dollars he can't pay. usually this is called a technical violation because he was unable to pay the amount. worst case scenario he will be sent back to jail/prison for violating his terms and conditions. main thing to do is talk to your parole officer about the amount, at best he may be able to help you.

  4. if the conditions of the probation are not met, your friend goes to jail.not real hard to understand, right?

best way to get out of this, tell your friend to get off his lazy butt, find a job and pay the fines,705.00 is NOT a big fine, and no,claiming he cant pay it wont get it reduced or recinded. If you cant do the time, dont do the crime.real simple.

  5. Read the conditions (sanctions) of the probation paperwork that was signed. If it says all conditions must be met and he hasnt completed his payments, he can have his probation extended until paid in full.

Technically, and as noted above me here, this is also a TPV (Technical Probation Violation), which means a law has not been broken, but conditions stipulated in writing have not been met. As such, if the PO wants, he could have full sentence imposed.

A lot of this will depend entirely on how he did his time on paper and how close he is to paying off the fine. In other words, it is a judgment call on the part of the PO.

Best advice: Pay the amount off in full.

Best of luck and I hope this is useful to you
