Problem on overstay while on tourist visa?

help me out on the following scenario:

A Filipino national comes to India on tourist visa valid for 3 months, marries an Indian. there then the persons visa gets expired for certain reasons.

Now whats the legal hurdles to be faced since the travellers over stay has crossed more than 3 months?

How to resolve it?

* The person is legally married to an Indian as of now.

  1. a visa does not expire for certain reason , it expires at the end of it's validity ,that is the only way .he has only overstayed his visa .

    visa have date to be respected in all countries

    he might be able to get an extension , but that has to be done before the visa expires ,not after .

    he will probalby get fines for each day overstayed ;
