Problem with Tenants

I recently leased my two bedroom apartment to a pair of seemingly decent and well to do brothers. Everything was fine; they pay rent on time etc. However, the other day while visiting my building I became mortified by what i heard. The first floor of the building which I rent out to a business informed what the tenants (brothers) had been up to. Apparently they are gang affiliated and the other night there was a huge fight in the apartment in which the police had to come. Now i had not heard any of this from police (a report etc.) and i fear for the welfare of my property and the business downstairs. What should i do?!

  1. If your lease agreement has a clause stating you can enter the apartment for one reason or another than I would call the police and have them come and escort you into the apartment for an investigation. I hope you know what is in your lease.. If it's not then make it a firmer lease.

WOW!  I would call the police and get a copy of the police report, then I would give them a 30 day notice (or whatever is legal in your state), to vacate.  We as property owners work hard at what we do, and pay the mortgage, taxes, insurance and sometime utilities, you don't need to have tenants like that in your building.  I would rather have it vacant.  We have evicted for activity like that before, and also have gone to court over it (and won).  Get them out before it gets worse, probably drugs involved too.

  3. Go contact the police and find out what's on the report. If you find out there's illegal activities involved, you can send them a 3 day notice and the reason of course is perform illegal activities and you have the police report to support you in the court. Don't worry about the lease is a year lease or month to month, you have the right to do that. Then after 3 days, file for eviction. The business people downstairs can be your witness, too.

  4. Is your lease agreement monthly or what? If it is monthly you can give a 3 day notice to quit and evict. You should go to the police station and see if they have a report and if they do, after you read it. Go and inspect your property to see if there was any damage done. If so you can evict. Not sure what state you are in as laws vary from state to state. You should look for a book that tells the rules of landlord evictions. if you can do it on your own without a lawyer, it can save you thousands of dollars. There is a lawyer that does a radio show for advice. The station is in California called KGO am newstalk radio...go to that site and click on his name it's Len Tillen you can send him an E-mail or if you want to call on the air his show is from 12 noon until 12:45 p.m. Monday through Friday and 4 p.m. to 7p.m. on Sunday. The Phone number is 415-808-0810 remember this is California time...he's very helpful...I believe he refers to a printing company called Nolo press try a search for it and see if it can get you to the do it your self landlord eviction book...........goodluck...oh yeah KGO is also streamed live online too........ ;)
