Problem with a public defender?!?

My brother's trial is about to begin. The PD wants him to plead guilty and take 3 years for something he didnt do. They are accusing my brother of having a gun and spray can, that he was tagging. There is no evidence that proves that. Just a cop saying he saw him toss the can to a bush. Ive spoken to the PD and he says there's strong evidence against my brother but wont give me more details. He has missed 3 court days. Can he be changed for another one or should my brother stick with him and refused to plead guilty and make it a good case and try to win it?? Any suggestions...?

  1. 3 years seems like a lot for tagging unless there is something else to it.....Previous criminal record, perhaps?

    He could always choose to plead innocent, but if the evidence IS substantial, he could be looking at a stiffer penalty.


  2. well you probably want to get advise from a private attorney or ask for another defender. If he believes that there is not enough evidence he should fight the charge

    the guy above me said it will eventually be dropped. That does seem likely for an offense like this

  3. tell your brother to stick to his guns and not plea guilty. Keep the public defender you are currently using, they are all about the same. Eventually, the charges against him will be dropped.

  4. He needs to ask for a new defender, tell them that he feels he will not be well represented with this guy.
