Problems with Walmart and Insurer Frank-gates??

I'm currently on a FLMA from a on the job injury to my lower back. It has been two weeks since I started the claim and I have only received one item from Frank-gates, the booklet and a cover letter about who will be dealing with my claim. I have a pending eviction, power shut off notice along with a phone shut off notice. Anyone else have a problem with their claim through walmart?? How much longer should I let them sit on it?? *I have already contacted a L and I lawyer who has successful cases in WA state, and they have told me to wait it out just a bit longer.... * I'm getting fed up with Walmart and Frank-gates. Nobody is releasing information to me and its MY case!!!

  1. You have already hired a lawyer, presumably for his expertise in Washington State labor law. Why not listen to your lawyers advice? After all you are paying him for his professional opinion. Do you think your going to get a better answer from uninformed strangers on Yahoo! Answers?

Um, right now, you don't have a problem with your claim.  With workers comp, it's usually about six weeks before you see any lost wages coverage.  That's because each state has a MANDATORY waiting time, where there isn't even any lost wages coverage, until after you pass that time (varies from three work days to 15 work days).  

    So, you've missed ten work days.  It's WAY too early to expect a check.  

    If you do hire a lawyer, it's going to really slow things down.  You won't be able to talk to the insurance company, and all communication - and checks - will have to go through your lawyer's office.  

  3. An on the job injury falls under Workers Comp, not FLMA (Family Leave Medical Act) and there is a waiting period to determine the length and severity of the disability.  You are no where near ready to expect a check.  Furthermore, your past due bills (eviction, power and phone) did not occur over a 2 week period, so you cannot blame WalMart for this situation.   The reason your lawyer told you to wait a "bit longer" is because you currently have no reason to believe that your claim will be denied and a L & I attorney (regardless of their TV advertisements) have to follow the law and aren't going to take a case unless there is a large contingency fee involved for them.
