I recently bought a used car that appears to have many problems that the dealer didn't even mention. I will explain all the thing below, just keep reading.

I live at Poughkeepsie, NY and I bought a used car in my area from a dealer. I was seeking for a car since the new year and I thought so that now its time to buy a car "whatever" it was. Anyway i went with my father and a friend of him that "knows" how cars works, he's been a driver for almost all his life, and he brought his son too.

When we got to the dealer the car was a Nissan 2000, with 100k miles and was selling it for $3900.

In the beginning we thought it was too much so we told him we would give 3000$ for the car cash. The dealer said "no way" at first, but then he said OK , $3000 but it goes $3300 with TAXES!

Anyway I wanted to buy the car because I was seeking one about January. Now that i bought it i think i didn't make the best decision because i was in a hurry to buy a car, but that was my fault.

  1. I think that that falls under the lemon law i'm not shore but look into it. Did you get a 3 month 3,000 mile wanante if so then have then fix it if not. Look up the lemon law in your town.

  2. Check your local lemon laws. I am pretty sure if the car turns out to be junk in 30 days the dealership/used car place must buy it back.(But that law changes from state to state)

Also I know around here the care must need to pass inspection from a dealer unless stated other wise.

THere is lemon laws in NY..(a) If your used car has more than 18,000 miles and up to and including 36,000 miles, a warranty must be provided for at least 90 days or 4,000 miles, whichever comes first.

    (b) If your used car has more than 36,000 miles but less than 80,000 miles, a warranty must be provided for at least 60 days or 3,000 miles, whichever comes first.

    (c) If your used car has 80,000 miles or more but no more than 100,000 miles, a warranty must be provided for at least 30 days or 1,000 miles, whichever comes first. Cars with over 100,000 miles are not covered.

Unfortunately you are not covered over 100 000 so your out of luck.

nick click the link it applies to both used and new cars. Used cars for 30 days. know the facts before you call someone out on it.

  3. Typically when you buy a used car, you are buying it "as is".  If the dealer offered a warranty for this vehicle (which is unlikely b/c of the mileage), then of course take it back for repairs.

But in the end, your "expert" friend approved of the car, and it has normal problems for a vehicle with that many miles on the engine.   And you say "the dealer didn't mention" the problems, however, you indicate that you knew about them BEFORE you made the purchase because your friend pointed them out, then your dad said "let's take it".

Next time you purchase a used car, have an actual mechanic look at and point out the problems before you make an impulse decision.

  4. Used cars are bought "as is".  The dealer is supposed to reveal any "defects" to you.  About all you can do is go back to the dealer and ask that the problems be corrected, no charge, by him.  If he won't, you can always report him to the BBB and/or your states office of consumer protection.  If he doesn't co-operate, tell him you plan to report him and then do it.

  5. In a word....no. You should have had a good mechanic check it over to point out all the problems. It was purchased as-is. You were right when you said you were in a hurry and it is your fault. You have no recourse. Fix it or sell it. To Jeffrey M...the "lemon law" does NOT APPLY TO USED CARS.
