Progressive not paying on their claims has anyone else had problems with this company?

I was in involved in a auto accident where i was side swiped by a progressive insured driver. I Pulled over in a parking lot and the lady that hit me said that she could not speak English and to wait for her husband, but she assured me she was insured. So long story short i wait for her husband the both of them conjure up a story that i hit her while i was on my cell phone and he was a witness only problem is there were independent witnesses that seen the whole thing plus i have cell phone records proving i was not on my phone the time of the accident. They claims adjustor called me a liar and said it was a word for word situation and she would not come out and investigate take pictures or anything. Well after three weeks of calling leaving messages they finally closed my case saying the witnesses failed to go on record. I'm now in the process of suing them and the person who hit for 10,000 dollars 3,000 for property damage, 2,000 for mental anguish and 5,000 for loss wages i have witness statements phone records car estimates and even a phone recording of the claim adjustor saying what they said happen. I believe all i need is statements from other accident victims that had similar situations I am so tired of dealing with they are very unprofessional and intimidating, but i just cant get screwed anymore is there anything else i can do or need? How should i go about this?

  1. Notify the police. They will give her a ticket, proving that she was at fault, not you.  Then her insurance company will pay for the damages to your vehicle.  

    You need to do it ASAP - before they get their car fixed, getting rid of the evidence.


  2. I have heard ALL kinds of horror stories.  My sugesstion to you is call write email whatever to your State Insurance Commisioner.  Explain what happened and what is happening now.  At the very least they usually do is write or call ALL partys involved.  Good Luck

  3. Why didn't you just file this under your own collision policy (oh, you don't HAVE collision --).

    This is a perfect example why you always have to protect yourself and not depend on other people to carry liability or to tell the truth. Now that you have a lawyer the situation will get even worse. $2K for mental anguish? Get real. $5K for 'lost wages'? Gimmie a break...

    As for your witnesses, you can't MAKE them testify in a civil case. Now your lawyer (the pig) will drain your bank account and drag this out for months and months.

  4. You realize you'll have to pay taxes on the $5K lost wages right?

    The rest is not taxable but lost wages are taxable.

    And if you used your health insurance company to pay for ANY hospital / dr bills related to the accident, they will take their cut of the $, and the attorney will take his (or her) cut before you.  

    The drunk (or drugged up) driver who smashed into my uncles yard had Progressive & he was pleased with how they handled the accidient.  Paid him for the fencing + time to install the fencing + the shrubbery he lost.  

  5. You should have called the police when it happened and then notified your insurance company.  Do both now !
