Property Rental contracts -Spain??

Does anyone renting property in Spain know, if it is the law, that the rental goes up every year according to the cost of living, or is that purely at the discretion of the owner?

  1. I don't personally rent property in Spain but know Spaniards who do. The price of the rent is up to the the owner. They can charge whatever they want. It's not at all unusual to find "more mature" owners asking surprisingly little for rent and the landlords tend to be very "hands off" but (sometimes) very good about maintenance issues. Many landlords PREFER to charge you in cash so that they don't have to deal with rental agreements NOR claim the income for taxes. That said, they can throw you out whenever they want too. Well, okay, they can't. There are laws against that, actually, if you don't have anywhere else to go. If renters don't want to leave, even if they haven't paid their bills in months, they can stay for months and months (sometimes years!) until the owner can get a court order to oust the renters. I've actually seen this process take a long time. I guess this is more information than you wanted to know though.

  3. Yes, contracts run for 11 months, then it can go Up- at Owners discretion. Although Many Cheap rentals as property not selling at the moment.

  4. Its been a few years since I rented property in Spain, if I remember correctly It down to the landlord I don't remember any state controls over rental increases.

  5. its not the law but its common practice.and normally its included in the original rental contract.personally i prefer this method,at least you know that when it comes to the end of the year you will be able to calculate what you are going to be paying for the next year.looking from the side of the owner of the property its logical that they are are not going to see thier investment losing value,ie,that the rent they recieve increments less than the cost of living.
