i live with my son Only his name is on the title

I helped him buy the house and helped pay to build the garage

Most of the receipts are in his hands as he told me he wanted them for tax purposes In order to avoid paying me back he might rent the place until the market improves, that way he will profit Now tells me I will not get anything back unless he sells the place but i will have to leave regardless If he rents and I refuse to leave, no doubt he could get a court order and have me tossed out I'm not a renter just a family member seems to me I'm just SOL It will be hard to prove what he owes me I can prove some by asking my bank for copies of all my ck for past 4 years He owes me 16K i gave him all the money I had Now he wants to kick me out and sell the place can i have a lien put on the house and because of the amount would I have to file in superior court could I do this by myself or would i need an attorney? trouble is I don't have any funds left as I gave him all

  1. If you get a judgment against him you can file a lien against the house, which guarantees that you get paid out of sale proceeds.  Get yourself an attorney, go to legal aid, go to county  public guardian and get help ASAP.  Don't wait.

    To get a judgment, you sue him in small claims court for the money you loaned him.  It is he says/she says, so get as much documentation as you can.


  2. You can't have a lien placed on the house unless you had a contract (written) with him prior to all of the money exchanged.
